Hilary Duff’s estranged husband is seeking joint custody of their son, it has been claimed.

The 27-year-old singer filed for divorce from former professional hockey player Mike Comrie back in February.

At the time, it was claimed that Hilary was seeking sole custody of three-year-old Luca, due to allegations surrounding Mike and his reported partying ways.

In fact, she filed the day after the Daily Mail reported Mike drunkenly propositioned a woman at Mastro’s Steakhouse in Beverly Hills.

The former Lizzie McGuire actress was apparently willing to offer Mike visitation rights.

However, TMZ.com claim they have seen documents saying that Mike is contesting Hilary’s filing and demanding joint custody of their little boy.

The outlet also report that Mike is happy enough to sort the pair’s property and spousal and child support issues by going by their prenup.

But he is said to be unwilling to give up his custody of Luca without a fight.

The claims are in sharp contrast to the united image Hilary put across of herself and Mike in an interview earlier this month.

“We are a unit and we’re going to be a unit for the rest of our lives,” Hilary told People magazine.

“We realised [as a couple] we weren’t where we used to be. But I feel so lucky this happened when Luca was young because this is his normal now.”

Hilary previously spoke about why she decided to wait so long before filing divorce papers.

She added that the pair’s “fight for happiness” and the wellbeing of their son are the most important things.

"We have a two-year-old together. We love each other. Obviously it wasn’t a rash decision that we made. We really are just trying to figure out how we are the most happy—whether together or apart—and we’re doing it as lovingly as possible," she revealed to Health magazine.
