The members of the Velvet Underground were dealt a partial blow in their suit against the Andy Warhol Foundation over the licensing and use of the iconic Warhol banana used on their album The Velvet Underground and Nico.

On Friday, a federal judge refused to hear a claim of copyright on the image, but that doesn't mean the case is over. It now moves to a new phase that will reexamine the claims from a trademark standpoint.
